Introduction: These Terms and Conditions (“Terms”) constitute a legally binding agreement between you and Growth App (“we,” “us,” or “our”). By accessing, downloading, or using the App, you confirm that you understand and agree to comply with these Terms in full. If you do not agree with any provision herein, you must discontinue use of the App immediately, as continued use signifies your acceptance of all obligations, rights, and responsibilities described below. The following General Terms and Conditions of Business set out the legal framework for using Growth App and the services that we offer. Therefore, please read these General Terms and Conditions of Business carefully.

Eligibility:

A condition for opening a user account and using the Growth services is that you are at least 16 years of age and have full legal capacity. By using the App, you represent and warrant that all information you provide during registration is accurate and that you meet all eligibility criteria. We reserve the right to temporarily or permanently restrict access to any user who provides false information or otherwise violates these Terms.

If your local laws set a higher age for contractual consent, that higher age controls. Growth App is intended exclusively for individual consumers for personal use. The legal definition of a consumer is every natural person that enters into a legal transaction for reasons that cannot be chiefly attributed to either their commercial or their self-employed occupation. Use of Growth App for commercial purposes of any kind is expressly prohibited.

Account Registration:

Creating an account requires you to submit a valid email address, a secure password, and additional onboarding information necessary for App functionality. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account. Any suspicion of unauthorized access must be reported to us immediately, and we are not liable for losses arising from your failure to safeguard your account information.

You may not share your account credentials or make your account available to anyone else and are responsible for all activities that occur under your account. If you create an account or use the Services on behalf of another person, you must have the authority to accept these Terms on their behalf.

During the onboarding process, the App will request personal and fitness-related information, including but not limited to height, weight, gender, age, goals, and motivational responses.

Certain features of the App rely on AI-supported processing to generate personalized recommendations and insights based on user-provided data; such processing is assistive in nature, does not produce legal or similarly significant effects, and does not replace user decision-making. This data is used to generate personalized recommendations and to support and operate AI-supported features within the App, without using personal data to train, develop, or improve general-purpose or foundational AI models. By using these features, you acknowledge and consent to the processing of your personal data by AI systems as described in our Privacy Policy. Growth App does not use biometric identification or sensitive data beyond what is necessary for personalization and functionality.

App Features and Services:

Growth App provides a multifaceted suite of fitness, nutrition tracking, progress tracking, and AI-assisted tools designed to support personal development and wellness monitoring.

All App features and services are provided for general fitness, wellness, and informational purposes only and are subject to the AI Disclaimer in Section 5 and the data processing terms set out in our Privacy Policy.

Progress Tracking:

The Progress Page enables users to upload photographs, log weight entries, and record various metrics over time. This functionality is intended to help users visualize long-term trends and monitor changes in their fitness journey. Growth App does not guarantee any specific outcomes from the use of these tools, and all progress measurements depend on user consistency and accuracy.

Workouts:

This feature includes structured workout programs, each tailored to support different training goals. Every exercise is accompanied by detailed set and repetition guidelines, along with demonstration videos. Users are responsible for performing exercises safely, and Growth App is not liable for injuries or harm resulting from improper form or misuse of the provided workout plans.

Home Page:

The Home Page provides users with a centralized overview of their fitness activity and progress within the App. This page may display upcoming workouts, progress charts, nutritional summaries including calorie and macronutrient information derived from the Meal Tracker, and workout activity history. The Home Page is intended for informational and motivational purposes only and does not provide medical or professional advice.

AI-Powered Meal Tracker:

The Meal Tracker allows users to describe meals in natural language, enabling the AI to approximate caloric and macronutrient values based on provided descriptions. These estimates depend entirely on the accuracy and detail of user inputs and may vary from actual nutritional values. Growth App makes no guarantee regarding the precision of AI calorie or macro calculations, and these outputs should be used as approximations only.

AI DISCLAIMER:

The App incorporates AI systems trained and fine‑tuned to support fitness guidance, nutritional estimation, habit‑building recommendations, and user engagement. Although these systems are designed to be highly responsive and context-aware, they may occasionally produce incorrect, incomplete, or imprecise information. By using Growth App, you agree that AI-generated outputs are supplemental in nature and acknowledge that all decisions regarding your fitness, nutrition, and wellness remain solely your responsibility.

Growth App’s AI agents may occasionally produce unexpected, inconsistent, or incorrect results due to technical limitations, model behavior, training data constraints, or system errors. The AI components may also be temporarily unavailable due to updates, maintenance, network issues, or third-party service interruptions. We do not guarantee uninterrupted access to AI features, and we are not responsible for any consequences arising from outages, inaccuracies, or system malfunctions.

What you can do. Subject to your compliance with these Terms, you may access and use our Services. In using our Services, you must comply with all applicable laws as well as our Sharing & Publication Policy⁠, Usage Policies⁠, and any other documentation, guidelines, or policies we make available to you.

What you cannot do. You may not use our Services for any illegal, harmful, or abusive activity. For example, you may not:

Use our Services in a way that infringes, misappropriates, or violates anyone’s rights.

Modify, copy, lease, sell or distribute any of our Services.

Attempt to or assist anyone to reverse engineer, decompile, or discover the source code or underlying components of our Services, including our models, algorithms, or systems (except to the extent this restriction is prohibited by applicable law).

Automatically or programmatically extract data or Output (defined below).

Represent that Output was human-generated when it was not.

Interfere with or disrupt our Services, including circumvent any rate limits or restrictions or bypass any protective measures or safety mitigations we put on our Services.

Use Output to develop models that compete with Growth App.

Due to the nature of our Services and artificial intelligence generally, output may not be unique and other users may receive similar output from our Services. Our assignment above does not extend to other users’ output or any Third-Party Output.

We may use Content solely to operate, support, and maintain the Services in accordance with our Privacy Policy, comply with applicable law, enforce our terms and policies, and keep our Services safe.

When you use our Services, you understand and agree:

Output may not always be accurate. You should not rely on Output from our Services as a sole source of truth or information, or as a substitute for professional advice.
You must evaluate Output for accuracy and appropriateness for your use case, including using human review as appropriate, before using or sharing Output from the Services.
You must not use any Output relating to a person for any purpose that could have a legal or material impact on that person, such as making credit, educational, employment, housing, insurance, legal, medical, or other important decisions about them.
Our Services may provide incomplete, incorrect, or offensive Output that does not represent Growth App’s views. If Output references any third-party products or services, it does not mean the third party endorses or is affiliated with Growth App.

Additional terms and conditions:

We reserve the right to agree to additional terms and conditions for individual Growth App Services. We will, however, notify you of this in good time prior to use. Any such additional terms will apply only upon clear notice to you and, where required by applicable law, your acceptance.

Growth App reserves the right to modify, update, discontinue, or remove features and functionalities of the App at any time without prior notice.

Payment, Subscription and Refunds:

Growth App Services are available exclusively through recurring subscription plans. Access to paid features is granted only upon the successful activation of a subscription.

Subscription Model and Payment:

Subscriptions are offered on an auto-renewing basis. Payment transactions are processed by Apple App Store, Google Play Store, and RevenueCat, acting in accordance with their own terms, privacy policies, and security standards. Growth App does not collect, store, or have access to users’ full payment card details or sensitive financial information.

Where subscriptions or in-app purchases are made through the Apple App Store or Google Play Store, payment processing and any related personal data processing are handled by the respective platform providers, acting as independent data controllers, in accordance with their own terms and privacy policies.

By subscribing, you authorize the applicable payment service provider to charge your selected payment method on a recurring basis until cancellation. You are responsible for maintaining valid and up-to-date billing information. Failure to process payment may result in suspension or termination of access to the Services.

The subscription term is determined by the billing cycle selected at the time of purchase and is independent of the extent or frequency of your use of the Services.

Subscriptions may be offered on monthly or annual billing cycles depending on the plan selected at the time of purchase.

Free Trials:

Where offered, the free trial period lasts seven (7) days, unless otherwise clearly stated at the time of subscription. The duration and applicable conditions of the free trial are clearly disclosed prior to subscription activation. Unless canceled before the end of the free trial period, the subscription will automatically convert into a paid subscription in accordance with the terms presented at the time of purchase.

Cancellation:

Users may cancel their subscription at any time through their account settings or via the payment service provider used at the time of purchase. Cancellation takes effect at the end of the current billing cycle unless otherwise required by applicable law.

Refunds:

Except for the 30-day refund guarantee described below and where required by applicable law, refunds are assessed on a case-by-case basis and are not guaranteed. Growth App reserves the right to request reasonable evidence of usage in order to evaluate refund eligibility.

30‑Day Refund Guarantee:

Growth App offers a 30-day full refund guarantee to users who demonstrate that they utilized the App in good faith yet did not experience any benefit or progress. To evaluate refund eligibility, Growth App may request evidence of usage (including workout logs, meal entries, or progress tracking data). Refund requests submitted after thirty (30) days from the initial payment date will not be honored, and refunds may be denied in cases of misuse, fraudulent claims, or abuse of the refund policy.

User Responsibilities:

You agree to use the App solely for lawful, appropriate, and intended purposes. Users must exercise caution when engaging in physical activity and understand that fitness training involves inherent risks, including injury. Additionally, you agree not to interfere with the App’s operations, attempt to reverse-engineer its systems, impersonate another individual, or provide intentionally inaccurate information.

Users are responsible for ensuring that any information they provide through the App is accurate and up to date, in accordance with the obligations set out in our Privacy Policy.

Termination:

We reserve the right to suspend, restrict, or permanently terminate user accounts at our sole discretion if we determine that these Terms have been violated. Termination may occur without prior notice in cases involving fraud, abuse of refund policies, security breaches, or illegal activity. Upon termination, users lose access to all App features and may no longer retrieve stored data unless required by law.

Any retention or deletion of personal data following termination will be handled in accordance with the data retention and deletion provisions set out in our Privacy Policy.

Privacy and DATA Protection:

Growth App processes personal data in accordance with applicable data protection laws and solely as described in its Privacy Policy, which forms an integral part of these Terms. The Privacy Policy governs the collection, use, processing, storage, sharing, and protection of personal data in connection with the App and shall prevail in the event of any inconsistency.

In the event of any conflict between these Terms and the Privacy Policy, the Privacy Policy shall prevail with respect to personal data processing matters.

Feedback: We appreciate your feedback, and you agree that we may use it without compensation to you, provided that any use of personal data contained in such feedback is handled in accordance with our Privacy Policy.

Health and Safety Disclaimers:

Use of the Growth App Services is at your own risk.

Use of the Growth App Services is intended only for individuals who are in an adequate general state of health to safely engage in physical activity, and users are solely responsible for determining whether their health condition permits such use. If you have knowledge of any pre-existing medical conditions, we advise you to seek medical advice from a doctor urgently before you start the Growth App Services (such as training routines). This applies in particular if you have knowledge of one or more of the following medical complaints/conditions/procedures: (i) cardiovascular disease, (ii) lung or respiratory disease (including asthma), (iii), spinal and/or joint problems, (iv) neuromuscular disease, (v) surgical procedures, (vi) any other health issues.

In case of Growth App Services related to nutrition, you are responsible for verifying that the foods and nutrients recommended through the App do not contain any ingredients or contents to which you are allergic or which may cause food intolerance.

In addition, users who are pregnant or breast-feeding are strongly advised to consult a qualified healthcare professional before engaging in any trainings offered through the App and to use the Services only if and to the extent deemed appropriate by such professional.

The following general rules apply: Listen to what your body is telling you. Before using the Growth App Services for the first time or while using Growth App, if you have any doubts about your health (e.g. because you are experiencing considerable pain, a general malaise, shortness of breath, nausea, or dizziness) consult your doctor before starting or continuing with Growth App.

Growth App does not diagnose, treat, or prevent medical conditions. You assume all risks associated with exercise and dietary changes.

For information regarding the use of artificial intelligence within the App and the limitations of AI-generated outputs, please refer to Section 5 (AI Disclaimer).

Intellectual Property:

All intellectual property associated with the App—including but not limited to software, AI systems, videos, workout plans, designs, text, graphics, and trademarks—is owned exclusively by Growth App and its licensors. Users are granted a limited, revocable, non-transferable license to access and use the App for personal purposes only. Unauthorized reproduction, distribution, modification, or commercial use of any content is strictly prohibited and may result in legal action.

For the avoidance of doubt, this section does not affect users’ rights in their own personal data or User-Generated Content, which are processed solely in accordance with our Privacy Policy.

Disclaimer of warranties:

TO THE FULLEST EXTENT PERMITTED BY LAW, THE GROWTH SERVİCES ARE PROVİDED “AS İS” AND “AS AVAİLABLE.” EXCEPT WHERE PROHİBİTED BY APPLİCABLE LAW, WE AND OUR AFFİLİATES, PARTNERS, AND LİCENSORS MAKE NO WARRANTİES OR REPRESENTATİONS OF ANY KİND, WHETHER EXPRESS, İMPLİED, STATUTORY, OR OTHERWİSE, İNCLUDİNG BUT NOT LİMİTED TO ANY WARRANTİES OF MERCHANTABİLİTY, FİTNESS FOR A PARTİCULAR PURPOSE, SATİSFACTORY QUALİTY, NON-İNFRİNGEMENT, QUİET ENJOYMENT, ACCURACY, OR UNİNTERRUPTED OPERATİON, AS WELL AS ANY WARRANTİES ARİSİNG FROM USAGE OF TRADE OR COURSE OF DEALİNG OR OR TRADE USAGE.

WE DO NOT WARRANT THAT THE SERVİCES WİLL BE ERROR-FREE, SECURE, ACCURATE, RELİABLE, OR AVAİLABLE AT ALL TİMES, OR THAT ANY CONTENT OR OUTPUT GENERATED BY THE SERVİCES WİLL BE CORRECT, COMPLETE, OR FREE FROM LOSS, ALTERATİON, OR CORRUPTİON. YOU ACKNOWLEDGE AND AGREE THAT ANY USE OF OUTPUTS FROM THE SERVİCES İS AT YOUR SOLE RİSK, AND YOU WİLL NOT RELY ON SUCH OUTPUT AS A SOLE SOURCE OF TRUTH, FACTUAL İNFORMATİON, OR A SUBSTİTUTE FOR PROFESSİONAL, MEDİCAL, LEGAL, FİTNESS, FİNANCİAL, OR OTHER EXPERT ADVİCE.

Nothing in this section shall exclude or limit any consumer rights that cannot be waived under applicable Romanian or European Union law.

Limitation of liability:

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE ROMANIAN AND EUROPEAN UNION LAW, GROWTH APP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, LOSS OF BUSINESS OPPORTUNITIES, OR LOSS OF USE, ARISING OUT OF OR IN CONNECTION WITH THE USE OF, OR INABILITY TO USE, THE SERVICES, EVEN IF GROWTH APP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

GROWTH APP SHALL NOT BE LIABLE FOR ANY DAMAGES RESULTING FROM RELIANCE ON AI-GENERATED OUTPUTS, FITNESS OR NUTRITION RECOMMENDATIONS, OR USER-GENERATED CONTENT, WHICH ARE PROVIDED FOR INFORMATIONAL AND WELLNESS PURPOSES ONLY.

WHERE LIABILITY CANNOT BE EXCLUDED UNDER APPLICABLE LAW, GROWTH APP’S LIABILITY SHALL BE LIMITED TO DIRECT DAMAGES THAT ARE FORESEEABLE AND DIRECTLY ATTRIBUTABLE TO A PROVEN BREACH OF THESE TERMS.

NOTHING IN THESE TERMS SHALL EXCLUDE OR LIMIT LIABILITY FOR WILLFUL MISCONDUCT, GROSS NEGLIGENCE, DEATH, OR PERSONAL INJURY CAUSED BY NEGLIGENCE, OR ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE ROMANIAN OR EUROPEAN UNION LAW.

Rights of Use over Growth App Content:

The services we offer contain content which is protected by copyright or otherwise and we hold the respective rights. We grant you a non-exclusive and non-transferable right to use this content solely for personal purposes within the scope of these Terms. Purely for the avoidance of doubt we draw your attention to the fact that in particular distributing our content or making it publicly available, e.g. on websites other than Growth App websites, is not permitted. The right of use will lapse when your access to the respective service is no longer enabled (e.g. after you have cancelled your subscription) or when your user contract ends.

Responsibility for User-Generated Content:

Users may upload photographs, progress logs, meal entries, or other content as part of their App experience. By submitting content, you grant Growth App a non-exclusive, worldwide, royalty-free license to store, process, and display that content solely for the purpose of providing App functionality, in accordance with our Privacy Policy.

You are solely responsible for any content, data, prompts, inputs, or materials (“User Content”) that you submit, input, or otherwise make available through the Growth App Services. You represent and warrant that you have all necessary rights to provide such content and that your User-Generated Content does not violate any law, infringe any third-party rights, or contain harmful, misleading, or inappropriate material.

We do not monitor or verify User Content or AI-Generated Content and are not responsible or liable for any loss, harm, or consequences arising from such content. We reserve the right—but have no obligation—to remove, restrict, or disable access to any User Content or AI-Generated Content that we determine to be unlawful, harmful, misleading, or otherwise inappropriate.

You acknowledge that sharing, publishing, or otherwise distributing your User-Generated Content or AI-Generated Content is at your own risk, and you are solely responsible for any consequences that may arise from doing so.

Disclaimer of responsibility for third party content:

The App may integrate with third-party platforms such as payment providers, cloud services, or analytics tools. These third parties operate under their own terms and privacy policies, and Growth App is not responsible for their actions, data practices, or service performance. By using the App, you consent to the sharing of necessary data with such third parties strictly for the purpose of delivering App functionality, in accordance with our Privacy Policy.

Communications and Notifications:

By creating an account, you agree to receive communications necessary for the operation of the App, including account-related messages, security alerts, billing notifications, and important service updates, which may be delivered via email, push notifications, or in-app messages. You may manage your notification preferences for non-essential communications through the App settings where available. Marketing or promotional communications are sent only where permitted by applicable law and may be opted out of at any time. Essential service-related communications cannot be disabled, as they are required for the proper functioning and lawful operation of the Services.

Governing Law and Jurisdiction:

These Terms shall be governed by and construed in accordance with the laws of Romania. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Constanța, Romania, without prejudice to any mandatory consumer protection rights under applicable European Union law.

Severability clause:

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid portion shall be modified only to the extent necessary to make it legally enforceable while preserving the original intent.

Entire Agreement:

These Terms constitute the complete and exclusive agreement between you and Growth App regarding the use of the App, superseding all prior proposals, understandings, or agreements, whether written or oral. No employee or representative of Growth App is authorized to modify these Terms except through official written documentation.

This includes, without limitation, the Privacy Policy, which forms an integral part of these Terms.
